Terms of Service

1. Acceptance of Terms

By accessing or using Pawtner ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and Timo Leisengang ("we," "our," or "us"), the operator of Pawtner.

2. Service Description

Pawtner is a pet care business management platform that allows pet service professionals to manage their clients, pets, schedules, visits, and invoicing. The Service includes:

• Client and pet information management
• Visit scheduling and tracking with GPS check-in/check-out
• Photo documentation during visits
• Visit report generation and email delivery
• Invoice creation, PDF export, and management
• Online booking system via public booking pages
• Client portal with self-service access (view visits, manage pets, update profile)
• Team management with role-based staff permissions
• Email notifications (visit reports, reminders, booking confirmations, staff invites)
• Data export functionality
• Subscription billing via Stripe

3. Eligibility

To use Pawtner, you must:

• Be at least 16 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws

By using the Service, you represent and warrant that you meet these eligibility requirements.

4. Account Registration

To use Pawtner, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities under your account

You may not share your account credentials or allow others to access your account. We reserve the right to suspend or terminate accounts that violate these Terms.

Pawtner supports passkey/WebAuthn as an alternative login method. You are responsible for securing all authentication methods associated with your account.

Business owners may invite staff members to their team. Staff members receive their own credentials and accounts. The inviting business owner is responsible for ensuring that their staff members comply with these Terms.

5. User Responsibilities

As a user of Pawtner, you are responsible for:

• The accuracy of all data you enter into the Service
• Obtaining necessary consents from your clients before storing their personal information
• Complying with applicable data protection laws when handling client data
• The quality and safety of the pet care services you provide to your clients
• Maintaining appropriate backups of your important data
• The actions of any staff members invited under your account
• Ensuring the accuracy of information displayed on your public booking page
• Informing your clients that their data is processed via the Pawtner platform and client portal

Pawtner is a tool to help you manage your business. We are not responsible for the pet care services you provide or any outcomes related to your business operations.

6. Acceptable Use

You agree NOT to use Pawtner to:

• Engage in any illegal activities or violate any applicable laws
• Upload viruses, malware, or other malicious code
• Attempt to access other users' accounts or data
• Interfere with or disrupt the Service or its infrastructure
• Use automated tools (bots, scrapers) to access the Service
• Resell, sublicense, or redistribute the Service
• Harass, abuse, or harm other users
• Upload content that is defamatory, obscene, or violates others' rights
• Circumvent any security measures or access controls

We reserve the right to investigate violations and take appropriate action, including suspending or terminating your account.

7. Content Ownership & License

Your Content

You retain full ownership of all content you upload to Pawtner, including client information, pet data, photos, and notes ("Your Content").

By using Pawtner, you grant us a limited, non-exclusive, royalty-free license to store, process, display, and transmit Your Content solely for the purpose of providing the Service to you. This license includes the right to send emails on your behalf (e.g., visit reports) and generate documents (e.g., invoices).

This license terminates when you delete your account or remove Your Content from the Service.

Our Content

Pawtner and its original content, features, and functionality are owned by Timo Leisengang and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our content without our express written permission.

8. Payment Terms

Pawtner offers free and paid subscription tiers. Payments are processed securely via Stripe.

• Subscription fees are billed monthly or annually, depending on the plan you select
• You may cancel your subscription at any time; access continues until the end of the current billing period
• Refunds are handled in accordance with applicable consumer protection laws
• We may change pricing with 30 days advance notice

9. Termination

By You

You may terminate your account at any time by contacting us at dev@leisengang.online. Upon termination, your data will be deleted in accordance with our Privacy Policy.

By Us

We may suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms
• Your use of the Service poses a security risk
• We are required to do so by law
• We discontinue the Service (with reasonable notice where possible)

10. Disclaimers & Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Any defects will be corrected
• The Service will meet your specific requirements
• The results obtained from using the Service will be accurate

We are not responsible for the accuracy of data you enter or the outcomes of your pet care business. The Service is a management tool; you remain solely responsible for the services you provide to your clients.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

Timo Leisengang shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the greater of:

• The amount you paid for the Service in the 12 months preceding the claim, or
• One hundred euros (€100)

These limitations apply regardless of the theory of liability (contract, tort, or otherwise) and even if we have been advised of the possibility of such damages.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Munich, Germany.

13. Dispute Resolution

We encourage you to contact us first to resolve any disputes informally. You can reach us at dev@leisengang.online.

For consumers in the European Union: The European Commission provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr/. We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date.

Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the changes, you should stop using the Service.
